Evolving international humanitarian legal regime for sustainable use of outer space and its application to India

  1. Book chapter titled: Indian Practice of International Space and Remote Sensing Laws, in Space Tourism Legal and Policy Aspects, Routledge - Taylor & Francis Group, 2024
    • Examines and analyses the legal framework applicable to outer space activities and remote sensing activities at the international level. The chapter has also analysed the legal framework in India concerning space activities in general and remote sensing in particular. As the implementation of international principles and policies relating to remote sensing is left to the respective state parties, the Indian practice of international remote sensing laws has been assessed by analysing various space policies and legislations including the SpaceRS Policy, 2020 and the SpaceRS NGP 2020.)

    • Space tourism – a dream for many – has become a reality, and recently the world is witnessing humans exploring the cosmos as a tourist. Earlier, exploration was the main aim of space activities; but privatisation has opened the doors for space tourism. International space law is focused on the aspect of space exploration and upholding the principle of the ‘common heritage of mankind’. Space tourism calls for a relook at the existing space laws at the international and national levels. The Liability Convention of 1972 and the national space legislation framed in conformity with this Convention have established a legal framework concerning the disputes and issues arising out of space activities. Though international space law has gained momentum as a separate branch of law, it is debatable whether these laws can be applied to all the legal disputes relating to space tourism. This chapter has analysed various issues regarding space tourism and laws at the international level, with a specific focus on liability issues. Space tourists are prima facie not going for any exploration purpose as focused by the space legislations, but that does not take away the responsibility of the international legal fraternity and keeps it as a vacuum.
